REINKE SHAKES warrants to the original purchaser of its shingles that for a period of 50 years from the date of purchase, when properly installed according to specifications of the manufacturer and in accordance with all applicable building codes, these shingles well prevent leakage, even in times of high wind and large hail, excluding leakage caused by wind exceeding 120 MPH, hail in excess of three (3) inches in diameter, or other acts of God, or from fire or harmful chemicals, or from mechanical damage such as: fallen trees, blown debris such as; glass, metal or branches.
REINKE SHAKES further warrants to the original purchaser of its shingles that for a period of 50 years from the date of purchase, when properly installed according to specifications of the manufacturer and in accordance with all applicable building codes, the "REINKE SHAKES" shingles well resist denting from hail up to one (1) inch in diameter.
Hail size and wind velocity shall be determined by the records of the National, State, and Local weather service or bureaus and the existence of hail over three (3) inches in diameter or wind exceeding 120 MPH in the area of installation since the date of purchase shall void this entire warrantee. The existence of hail over one (1) inch in diameter in the area of installation since the date of purchase shall void the dent resistance warrantee. Shingles are not warranted to prevent leakage or resist denting when caused by a failure of the roof structure to which the shingles are attached and failure of the roof structure to which the shingles are attached shall void this warranty.
This warrantee covers damage only from wind and hail as the sole cause of damage and does not cover damage from other acts of God, or from fire or harmful chemicals, or from mechanical damage such as: fallen trees, blown debris such as; glass or branches. The dent resistant warrantee does not apply to depressions near the nails that normally occur during the installation process.
Repair or Replacement: REINKE SHAKES will replace shingles, F.O.B. Factory, which do not conform to this warranty, after receiving a written claim by the purchaser accompanied by a copy of the contract for the purchase of the shingles and a copy of the Homeowner's Warranty Certificate. Upon receiving such a request, REINKE SHAKES shall have the right to examine the defective shingles to determine their condintion. The cost of replacement, excluding costs of labor, shall be pro-rated between REINKE SHAKES and the purchaser on the following basis: Purchaser shall pay two (2) percent per year of the service of the shingles on the roof, on the warranty replacement costs. Labor or installation costs and freight shall be the responsibility of the purchaser.
Exceptions or Exclusions: This warranty is the only express warranty made and there are no other express warranties except as made herein. Replacement as provided herein is the exclusive remedy for a breach of the express warranty given herein. The fluorocarbon color coating of the shingles is warranted only to the extent guaranteed by our suppliers of coated metal. Only damaged shingles will be replaced, and in the event a portion of the installed shingles are replaced, an exact color match is not guaranteed.
IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR USE ARE LIMITED IN DURATION TO THE DURATION OF THE EXPRESS WARRANTY GIVEN HEREIN. THERE IS NO WARRANTY COVERING AND REINKE SHAKES SHALL NOT BE LIABLE FOR ANY CONSEQUENTIAL DAMAGES, INCIDENTAL DAMAGES OR INCIDENTAL EXPENSES, INCLUDING INJURY TO PROPERTY OR PERSON.
This warranty gives you specific legal rights and you may also have other rights which vary from state to state. Some states do not allow limitation or exclusion on implied warranties, or on incidental or consequential damages, so the above limitation or exclusions may not apply to you. This warranty only applies to shingles sold in the United States and Canada. This warranty applies to shingles sold after Jan. 1, 2004
Limited Transferability: This warranty will be extended to the first subsequent transferee of the property to which REINKE SHAKES shingles were installed by the original purchaser if proper notice of the change of title or ownership is signed by the original purchaser and the transferee and mailed to REINKE SHAKES within thirty (30) days of the transfer, the terms of this warranty shall be limited to the term of the warranty then remaining.
Registration Requirements: This warranty is only valid and enforceable if the warranty application form is completed and signed by the original purchaser and mailed to REINKE SHAKES within thirty (30) days after the purchase date.
